Case A — Multi-asset estate, single executor, no will

The Situation

A Bangkok resident passed without a will. The estate included a registered condominium, two bank accounts, and a car. Three statutory heirs — two adult children and a surviving spouse — needed the estate formally administered before assets could be transferred.

How We Assisted

Phra Legal prepared the executor appointment petition for the Bangkok Civil Court, compiled the asset schedule, and coordinated the Land Department and bank notifications. The executor — the surviving spouse — received a step-by-step guide and was supported through each court and institution visit.

Outcome

The estate was fully administered in approximately seven months. The condominium was transferred to the beneficiaries and the bank accounts distributed according to the statutory shares. No disputes arose during the process.

Case B — Contested will, four siblings, Pathum Wan property

The Situation

A handwritten will signed shortly before death left the family's central Bangkok property entirely to one sibling. Three others disputed its validity on the grounds that the deceased lacked capacity at the time of signing, and that the will had not been properly witnessed.

How We Assisted

Phra Legal was instructed by the three disputing siblings. We assessed the legal position carefully and advised that the witnessing issue was the stronger ground. After correspondence with the opposing party's advisers, negotiations took place over several months with both sides accepting that full court proceedings would be costly and uncertain.

Outcome

The matter settled before proceedings were formally filed. The property was transferred and the proceeds distributed among all four siblings according to a negotiated agreement. The family relationship, while strained, remained intact — an outcome the clients had specifically said they wanted to preserve.

Case C — Foreign heir, Thai estate, land restriction advice

The Situation

A European national had been named a beneficiary in the will of a Thai relative. The estate included a house with land title. The client was uncertain about their inheritance rights as a foreign national and whether they could retain the property.

How We Assisted

Phra Legal provided a consultation explaining the relevant provisions of the Land Code and the Ministry of Interior guidelines on foreign inheritance. We advised on the timeline for any required transfer or sale and outlined the options available — including sale to a Thai national and monetary distribution of the proceeds.

Outcome

The client chose to sell the property to an agreed buyer within the permitted period. Phra Legal advised on the process and the proceeds were transferred to the client abroad. The client received the full benefit of the inheritance in a compliant and orderly way.
